UK261 compensation can only be denied if the flight was canceled primarily due to “extraordinary circumstances”. The courts have defined “extraordinary circumstances” to be events that are not inherent to operating an airline and are beyond the actual control of the airline. This is a very narrow definition that mainly applies to things like natural disasters or ATC grounding all flights at an airport. You could try to argue with EasyJet about this over email but in all likelihood they won’t budge and you will need to escalate this to AviationADR, who are the registered mediator for EasyJet. Here’s what I’d do: 1. Contact EasyJet one more time. Explain you believe you’re entitled to compensation unless they can explain why they believe extraordinary circumstances were present, and that you will file a claim with AviationADR if you are not satisfied with their explanation. 2. File a claim with AviationADR. Explain that your flight was canceled, and that the pilot informed you at the gate that this was due to crew availability, and you’re therefore entitled to UK261 compensation that the airline is refusing. In all likelihood they will just settle the case immediately via ADR.
